RFK Jr, You’re Not Just Distracted—You’re in Violation of Public Law 90-602

By John Coates, Founder of RF Safe

Let’s be clear: Robert F. Kennedy Jr. isn’t just any politician anymore—he is now Secretary of Health and Human Services, and with that comes a legal responsibility. Specifically, he is tasked with enforcing Public Law 90-602, the Radiation Control for Health and Safety Act of 1968.

This law isn’t optional. It’s not negotiable. It requires ongoing research and evaluation of radiation-emitting devices, including the cell towers and wireless technology that saturate our communities, our schools, and our children’s bodies with microwave radiation every single day.

Yet currently, there is no ongoing federal research evaluating the health impacts of RF radiation exposure, despite the National Toxicology Program (NTP) having clearly found evidence of cancer before being defunded by the Biden administration in 2024.

This means Secretary Kennedy is now actively in violation of the very law he’s sworn to uphold.

Ignoring Real Threats While Targeting Our Children

Rather than addressing his duty under Public Law 90-602, RFK Jr. has chosen instead to enforce a symbolic policy banning cell phones from schools. But let’s face reality: the children suffering cancer at Weston Elementary School in Ripon, California, didn’t have cell phones. They had a cell tower right on their school grounds.

Sprint eventually removed the tower—not because it violated outdated FCC guidelines, but because multiple children were diagnosed with rare cancers. The exposure was ambient. The damage was undeniable. Yet, RFK Jr. chooses to ban phones, a gesture that will not protect children from the towers still standing next to their classrooms.

Section 704: Stripping Away Our Rights

RFK Jr. knows better. Section 704 of the Telecommunications Act of 1996 legally strips communities and parents of their right to challenge cell tower placements based on health concerns. This is a blatant violation of our First Amendment right to petition our government and our Tenth Amendment right to local autonomy.

The same year Section 704 was enacted, the FCC solidified the fraudulent “thermal-only” safety guidelines, ignoring decades of U.S. military research from the Navy (1971), the Air Force (1984, Dr. Guy), and even the CTIA’s own studies—all confirming significant non-thermal biological risks.

Parents Deserve Truth—Not Top-Down Mandates

The fundamental problem isn’t children holding cell phones. It’s that parents have been intentionally kept in the dark. If parents were honestly informed about the scientific evidence of harm—neurological effects, reproductive damage, DNA breaks, and cancer—they would naturally choose to limit their child’s exposure. RFK Jr. doesn’t need to mandate rules against children; he needs to mandate transparency and truth from captured regulatory agencies.

Scientific Consensus vs. Regulatory Capture

Thousands of peer-reviewed studies document the non-thermal risks of RF radiation. The scientific community long ago reached consensus: non-thermal biological damage is real and serious. The only dissenting voices come from regulatory agencies like the FCC and FDA, which are thoroughly captured by the wireless industry’s billions.

This isn’t new. Historically, powerful institutions cling desperately to outdated models of reality—like authorities who maintained a geocentric universe despite overwhelming evidence otherwise—to preserve their power and profits.

Mr. Kennedy: Uphold Your Oath, Enforce the Law

Secretary Kennedy, you’ve called RF radiation dangerous yourself. You know the science. You campaigned against corporate capture. Yet now, you’re the one responsible for allowing corporate capture to continue. By failing to enforce Public Law 90-602 and allowing the National Toxicology Program to remain unfunded, you’re actively complicit in the harm inflicted on our children every day.

We don’t need your symbolic bans. We don’t need performative politics. We need:

  • Immediate reinstatement and full funding of the National Toxicology Program’s research into RF radiation.
  • Enforcement of Public Law 90-602 to ensure continual oversight and updated safety standards.
  • The repeal of Section 704, restoring parental and community rights.
  • Transparent education for parents, empowering them to make informed choices.

Do your job, Mr. Kennedy. Enforce the laws you’ve sworn to uphold.
